About This Item
Frontis to Volume I William Smith (1728-1793), Chief Justice of Quebec and of Lower Canada (1786-93), was born in York and educated at Yale College (B.A., 1745). In 1769 he was appointed a member of the Executive of New York, and in 1780 Chief Justice of the province. During the American Revolution, he was a staunch loyalist, and in 1784 he left New Yorkwith Carleton for England . When Carleton returned to Canada in 1786 as governor-in-chief of British North America, Smith came with him as chief justice of Quebec. As such, he had much to do with the framing of the Constitutional Act of 1791. Under the Act he became chief justice of Lower Canada, and speaker of the Legislative Council; but he died shortly afterwards at Quebec, on December 6th, 1793. [Wallace p.703]
