Macmillan, a minister of the Free Church of Scotland, was dismissed from his congregation after he was charged with drunkenness and "violently laying hold of a woman." He brought suit against the church in civil court. Given the prickly attitudes of Scottish dissenters toward any suggestion of government interference with their church polity, this case opened up a number of thorny issues concerning governance and the role of civil law in ecclesiastical affairs.
