Estudo feito na sequência da necessidade de codificação dos usos e costumes dos indígenas da província de Moçambique, de modo a que se pudesse reconhecer a existência legal de um estatuto civil indigena para se poder organizar um regime de justiça aplicável aos indígenas, questão que aliás já tinha sido levantada por Marnoco e Sousa na sua Administração Colonial, acerca do decreto de 18 de Dezembro de 1869 que estabelece o novo Código Civil na Metrópole e nas colónias. Marnoco e Sousa estabelece um paralelo com a legislação inglesa e a figura legal criada pelo império colonial britânico com as "Native Laws".
